Abstract

Problems regarding land are still being discussed in the community which results in land disputes becoming a struggle so that people blame each other even to the point of being hostile to the lossesthat the community has experienced. Because losses are the main conflict in road widening issues, justice must be enforced so as to produce a fairness in proper and fair compensation for road widening that the community is experiencing. Regarding the formulation of the problem, which is related to how the legal protection for people who do not get compensation from the government and formulate how the role of the government towards people who do not get compensation. The related objectives are to analyze the legal protection for people who do not get compensation from the government and to analyze the role of government towards people who do not get compensation. The research method used is the normative juridical method which focuses on statutory regulations, to approach the problem using a statutory approach., the source of legal material consist of primary legal material sources, secondary legal sources and tertiary legal sources which are collected and processed using the technique of tracing legal materials which was analyzed using qualitative methods. The results of this study indicate that for someone who does not get compensation from the government so that justice is not felt by the community and becomes a problem for the community and they want a proper and fair compensation. So that a legal protection is needed in upholding justice for people whose land is affected by road widening. Road widening that causes harm to the community must get attention from the Government so that justice can be felt by those who feel aggrieved and legal protection is a protection for the community from the Government in the implementation of road widening. So that the laws and regulations related to the problems of community land affected by road widening can be enforced justice in determining the compensation experienced by the community.
